Meal and Rest Breaks

Sidney L. Gold & Associates understand an employer’s responsibilities to provide workers paid breaks and unpaid meal periods.  Federal law does not require employers to provide paid breaks or meals, but many states have laws that do require employees receive paid break times and meal periods.  The laws are complex and vary from state to state, and employees who feel their rights are violated under the wage and hour laws need to consult with an experienced employment lawyer.

Under federal law, employers that provide rest periods under 20 minutes are required to pay the employee for this time; however, a meal period lasting 30 minutes does not have to be paid if it is an uninterrupted break.  If an employee works through their meal period, then they are entitled to be paid.  These stipulations become important in determining full time and part time employment, and in calculating overtime compensation.
