Philadelphia Employment Discrimination Attorneys Report on Pending Pregnancy Discrimination Legislation

The Pregnancy Discrimination Act of 1978 (PDA) amended Title VII of the Civil Rights Act of 1964 to forbid discrimination based on pregnancy with regard to any aspect of employment including hiring, firing, pay, job assignments, promotions and training. Under the PDA, women who are pregnant or affected by pregnancy-related conditions must be treated in the same manner as other applicants or employees with similar abilities or limitations.  The PDA applies to employers with 15 or more employees.

Unfortunately, many agree that the PDA alone is not adequate to safeguard pregnant workers from discrimination.  Advocating for greater protections against pregnancy discrimination, Senator Bob Casey from Pennsylvania has introduced a new bill in the Senate called the Pregnant Workers Fairness Act.  The objective of this bill is to reinforce the 1978 law by requiring employers to make “reasonable accommodations” for pregnant employees in the same way they would accommodate an employee with any debilitating illness or disability. The legislation would require employers to “reasonably accommodate” a pregnant worker’s requests, such as providing a stool so a woman could sit to perform a task or reassigning responsibilities involving heavy lifting. The bill also would prohibit firing pregnant women or forcing them to take unpaid leave for requesting accommodations.

Additionally, a companion bill to the Senate bill was recently proposed in the House also called the Pregnant Workers Fairness Act.  However, the House bill has yet to be sent to committee for consideration and is not expected to be successful.
