Our Attorneys at Work: Racial Discrimination Case against Norristown for Denial of Promotion

Last month, the Pennsylvania employment discrimination lawyers at Sidney L. Gold & Associates, P.C. in Philadelphia filed a charge of discrimination with the United States Equal Employment Opportunity Commission against the Municipality of Norristown on behalf of a Caucasian Lieutenant who was denied a promotion to the position of Chief of Police solely on the basis of his race.

During his twenty-eight (28) year tenure of employment, the employee received steady promotions and maintained an excellent job performance rating.  The employee alleges that beginning in 2012, the employer embarked upon a discriminatory hiring process in which it purposely narrowed its selection criteria solely to the applicants’ race.  The employee learned that in November of 2012, a Caucasian Council Member stated that it was “our turn” to place an African-American in the position of Chief of Police. As further evidence of the Municipality’s discriminatory motive, the employee discovered in minutes from Executive Sessions of the Town Council that various members of the Council stated their intent and desire to hire a “Black Chief.”

In November of 2012, the employee registered a complaint of race discrimination with the Municipal Manager, yet he failed to conduct an investigation or take steps to halt the Municipality’s discriminatory hiring scheme.  In August of 2013, the employee officially learned that he would not be promoted to the Chief of Police position and that a significantly less qualified, less experienced African-American individual received the position in his stead.  Sidney L. Gold & Associates, P.C. has asserted claims against the Municipality for race discrimination and violation of the employee’s right to equal protection.
