According to allegations in a new federal discrimination lawsuit, a former employee of the Berks County, Pennsylvania nursing home, Berks Leisure Living, has been the victim of unlawful harassment and discrimination. Former nursing home cook, Lisa Abraham, alleges that male supervisors and co-workers engaged in repeated discriminatory and harassing behavior towards her including verbal threats, vandalism to her car and ultimately unjustified termination on the basis of her gender and disabilities.

Ms. Abraham, who suffers from fibromyalgia and rheumatoid arthritis, began working for Berks Leisure Living in October 2010 as cook and dietary manager. Her employer was fully aware of the physical limitations that resulted from her disabilities including her difficulty in lifting, climbing and running.  By the Spring of 2012, Ms. Abraham began experiencing a hostile work environment as a fellow male cook began using derogatory language towards her and other women while in Ms. Abraham’s presence.  Despite informing her employer of the situation, the owner of Berks Leisure Living failed to take any form of corrective action.  Even after notifying her employer of a physical threat made against her and an incident of tire slashing in July 2012, the owner again refused to take any action.

By September 2012, preferential treatment of male employees (with respect to parking privileges, hourly wage, dress code and use of printers) and unreasonable requests for physical tasks (including lifting) increased. When informing her supervisor of her inability to engage in certain physical jobs due to her disabilities, Ms. Abraham was demoted, suspended and eventually terminated from employment in December 2012.
