Sidney L. Gold of Sidney L. Gold & Associates, P.C. and Robert Davitch of Sidkoff Pincus & Green successfully represented two employees in a whistleblower claim that resulted in a $662,000.00 settlement against Easton Hospital. The civil suit was filed by the U.S. Department of Justice under the False Claims Act. The suit alleged that Easton Hospital billed Medicare for procedures performed by Dr. Thomas Walden,
including extra corporeal shock wave lithotripsy, cystometrogram green light laser, and transurethral resection of the prostate. The suit alleged that some of these procedures were not performed, were only partially completed, or were medically unnecessary. Easton Hospital denied any wrongdoing.

During the course of their employment at Easton Hospital, the two whistleblower employees discovered the Medicare fraud scheme perpetrated at Easton Hospital which included the urologic procedures and tests performed by Dr. Walden for which the government was fraudulently billed by Easton Hospital.  The case was investigated by the United States Attorney’s Office for the Eastern District of Pennsylvania, the United States Department of Health and Human Services – Office of Inspector General, and the United States Office of Personnel Management – Office
of Inspector General. The settlement was announced on December 22, 2014.
