New Jersey Discrimination Lawyers Discuss Boy Scouts’ Employment Policies

The office of the New York State Attorney General has opened an investigation into the Boy Scouts of America to determine if the organization’s hiring policies discriminate against gays. The inquiry comes several weeks after a Boy Scouts’ New York City affiliate announced that it hired 18-year-old openly gay Eagle Scout to work at a scout camp this summer.

Though no moves have been made to prevent the teen from starting his position as scout leader, a review of the Boy Scout’s membership policies prompted the Attorney General to ask for detailed information regarding the national organization’s involvement with hiring decisions there and at its local councils. The letter addressed a provision in the policy that could result in a person being denied job opportunities because of their sexual orientation.

The Boy Scouts of America maintains a policy that excludes openly gay people over the age of 18 from becoming members – a policy that was upheld by a Supreme Court decision in 2000. The group also has a policy that states that a job applicant cannot be hired unless he has been admitted as an adult member of the Scouts. Therefore, this membership policy has the potential to restrict a person who has been denied membership because they are gay from being hired. If this were the case, it would be a violation of anti-discrimination laws in states that prohibit employers from making hiring decisions based on sexual orientation.

Currently, there are no federal laws that prohibit private employers from discriminating against individuals based on sexual orientation or gender identity. Several states have implemented anti-discrimination laws that address the issue, but the specific protections these laws offer vary widely by state. In New York, for example, the law prohibits employment discrimination on the basis of sexual orientation, but right now offers no protection for transgender individuals.
