Philadelphia Employment Lawyers Discuss EEOC Age Discrimination Suit

The Commonwealth of Pennsylvania Office of Open Records is being sued by the Equal Employment Opportunity Commission (EEOC) for alleged age discrimination for failing to hire a qualified attorney because he was close to retirement age. The plaintiff in the case says he was refused a position in the Office of Open Records after an administrator questioned him about his retirement plans during his second interview for the vacant position of an appeals officer for the state. The interviewer expressed concerns that the applicant was close to the age of retirement since he was over 40 years of age and had worked with the Commonwealth for over 17 years.

Federal law prohibits discrimination on the basis of age under the Age Discrimination in Employment Act of 1967. Under this law, employers are responsible for hiring the most qualified applicant for a position, regardless of their age. The EEOC claims that their client was refused employment simply because of his perceived retirement plans based on his age. Even though their client was fully qualified for the vacant position, the Office of Open Records hired someone 15 years younger with far less experience than the plaintiff.

Lawyers for the EEOC tried to negotiate an out of court settlement, but when those negotiations failed, they filed the case in the U.S. District Court for the Middle District of Pennsylvania. Attorneys for the defense deny discriminatory action and say their clients are eager to have their day in court.
