Philadelphia Age Discrimination Lawyers: Local Salon Targeted in New Lawsuit

An alleged policy by the Essentials Salon and Day Spa in Doylestown, Pennsylvania of hiring only young employees has sparked a new federal lawsuit by a spurned job applicant. According to the filing by a 54-year-old job candidate, the spa passed her over for a position in July 2015, purportedly because of her age. In the age discrimination lawsuit, the plaintiff is seeking more than one million dollars in damages, representing wages she claims she would have earned over the next 16 years had she been employed by the spa. Additionally, the plaintiff seeks damages for emotional distress, attorney’s fees and costs and punitive damages.

The Pennsylvania Human Relations Act counsels that workers over the age of 40 cannot be discriminated against on the basis of their age. All employers with employees of four or more within the state of Pennsylvania are bound by the PHRA. The Age Discrimination in Employment Act (ADEA), enacted by Congress in 1967, similarly provides protection for employees 40-years of age and older. Under the federal statute, it is unlawful for an employer to refuse to refer for employment or otherwise discriminate against any individual on the basis of their age.

Federal and state employment discrimination lawsuits cannot be filed without first exhausting the administrative remedies available under the PHRA and ADEA, however. To that end, an employee who believes he or she has been discriminated against and intends to pursue a federal claim must first pursue an action before the Equal Employment Opportunity Commission (EEOC). Employees alleging a state discrimination claim must first file with the Pennsylvania Human Rights Commission (PHRC). Upon dismissal by either entity, an employee may bring a lawsuit in court. This lawsuit, filed in the U.S. District Court for the Eastern District of Pennsylvania, advances employment discrimination claims under both state and federal statutes.
