A company that publishes newsletters and employs telemarketers to sell its newsletters based in Malvern, Pennsylvania, has been ordered by a U.S. District Judge to pay $1.75 million to 6,000 employees who are entitled to unpaid wages and damages. American Future Systems, Inc., which does business as Progressive Business Publications, required employees to “clock out” for short breaks when they would to go to bathroom or grab a cup of coffee.
The Labor Department filed a lawsuit in 2012 claiming that the company’s policies were in violation of the U.S. Fair Labor Standards Act (FLSA) because minimum wage earners were actually earning less than minimum wage after their pay was docked for brief breaks. The company must now submit a payment plan to the judge detailing how they will repay the money owed to 6,000 employees in New Jersey, Ohio and Pennsylvania who worked for Progressive Business Publications from July, 2009 to July, 2013.
