Non-Compete Agreements

Philadelphia employment lawyers at advocate for those affected by non-compete agreements.The state of Pennsylvania has recently proposed a bill that is aimed at banning all non-compete agreements in ordinary employment relationships. Pennsylvania House Bill 1938 would prohibit all such agreements, other than those that arise out of the sale of a business, or the dissolution or disassociation from a partnership or a limited liability company.

It is perceived that non-compete agreements suppress innovation and drive workers out of the state. That may be partly because many small businesses cannot afford the cost of paying an employee while waiting for that employee’s non-compete period to expire.

With the current state of non-compete agreements in Pennsylvania, some experts believe that many highly qualified individuals must leave the state if they want to advance their careers. The goal of the bill is to give Pennsylvanians the opportunity to remain in the state and make the most of their earning capacity.
