The U.S. Department of Justice (DOJ) states that cases of transgender discrimination at work are not covered under law. On August 16, the DOJ informed the U.S. Supreme Court that transgender workers are not covered under Title VII of the 1964 Civil Rights Act despite other cases resulting in successful outcomes citing employment discrimination of transgender workers. The DOJ claims that the law refers to inequality between male and female employees, which is unfair to workers who identify as transgendered. In October, the Supreme Court will review three employment discrimination cases to determine if LGBTQ workers may be covered under Title VII.
