Employee Files Against PNC Bank for Employer Negligence

PNC Financial Services Group, Inc. is facing a lawsuit after failing to keep an employee safe from a repeat sexual assailant. According to reports, the sexual assailant was a client at a PNC location and had multiple reports against him for sexually assaulting African American women at the organization. The last report filed by a victim claimed that PNC was negligent for failing to cut ties with the wealthy client.

According to the victim, the client waited outside the PNC location after her shift ended and forcibly grabbed and grinded on her. He was later charged with sexual assault, however, he died before the case could go to trial. Despite his death, the victim was able to obtain damages. Reports claimed that the victim reached a settlement with the assailant’s estate. Despite this settlement, the victim is still hoping to obtain damages from PNC for their role in the incident. The lawsuit stems from the victim’s lost work capacity, due to the trauma she endured from the sexual harassment. Although PNC denied claims of its negligence, the victim is expected to obtain over $2 million in damages.

Employer Negligence

Employers are responsible for taking care of their employees. Although many find it confusing why PNC is liable for the victim’s injuries. Laws state that employers are held liable for a sexual harassment case if they knew of the harassment and did not try to prevent it. This further proves that PNC is partially liable for the incident, despite not employing the abuser. Essentially, their failure to act led to an unsafe work environment for the victim, leading to the sexual harassment.

Beyond the law, it is encouraged that employers talk to workers about their sexual harassment policies, provide training, and handle all claims. This is important because it boosts employee morale by ensuring that workers feel comfortable reporting incidents.
