The exceptions to Chapter 9-4700 in the Philadelphia Code provide a wide berth for many employers to continue these screenings. Here are the exceptions to the change:

  • Police officers or other law enforcement positions.
  • A position requiring a driver’s license.
  • Any position requiring the supervision of children, medical patients, the disabled, or other vulnerable individuals.
  • Any position in which an employee could significantly impact the health and safety of other employees or members of the public.
  • It does not impact any positions involving federal or state regulations requiring drug testing for safety and security purposes.
  • Any employer who receives federal grant money or federal financial assistance that requires drug testing as a condition of receiving the funds.
  • Any employers who are part of a collective bargaining agreement that specifies pre-employment drug testing.
