Sidney L. Gold of The Gold Law Firm P.C., along with co-counsel Robert Davitch of Sidkoff, Pincus & Green, represented the whistleblower in a False Claims Act (FCA) suit against the mental health clinic, Tree of Life Behavioral Services. The former employee, who acted as a whistleblower in the case, claimed that the clinic falsely billed Medicaid for services rendered that patients did not receive and that they paid health care professionals including a social worker for client referrals for said services as well. Allegedly, the clinic fired the former employee in April 2013 because she refused to go along with the purportedly fraudulent practices despite receiving multiple promotions within the company in the past. A $1.65 million settlement will be paid to the whistleblower by the clinic, which closed its doors on December 30, 2019.
Individuals who decide to become whistleblowers and report fraudulent or dishonest practices in which their former or current employers may engage could face issues brought on by their acts of bravery. They may experience a hostile work environment followed by retaliation in the form of being demoted from their current positions or dismissed from their jobs. Fortunately, whistleblower laws protect those who choose to report their employers’ wrongdoing to the government and other authorities.
