Temporary Restraining Orders
When an employer tries to stop an employee from breaching a restrictive covenant agreement, they file for a temporary restraining order (TRO) that will restrict the employee from taking certain actions until a judge can decide whether to grant the applicant a preliminary or permanent injunction. If the employer files for a TRO on an ex-parte basis, the judge can grant the TRO without first notifying the employee.
Sidney L. Gold & Associates represent employees who are facing TROs and injunctions being filed against them. Often times, the TRO or injunction is an attempt to enforce a non-compete clause, non-solicitation provision, or a confidentiality agreement when an employee leaves an employer. Avoiding the TRO or injunction allows the employee the opportunity to work or pursue employment.
