Chester County LGBTQ Employment Lawyers

Fighting for LGBTQ Protection in the Workplace

In the Greater Philadelphia Area, as well as the rest of the country, there has been a push for more acceptance and representation for LGBTQ workers in the professional world. And while this has helped to spread awareness, it has not done much to curtail the prevalence of LGBTQ discrimination in the workplace. Consulting an employment lawyer who is compassionate supporter of the LGBTQ community will bring about the change needed for these workers.

At Sidney L. Gold & Associates, our Chester County LGBTQ discrimination lawyers are staunch allies of individuals in the community, and have done much to represent LGBTQ workers in the Delaware Valley. However, there is still much work to be done, as LGBTQ individuals face harassment and discrimination on a daily basis. Our LGBTQ lawyers can be the agents of change you need. We have represented LGBTQ employees in every conceivable way, and have provided successful representation in the ways described below.

Discriminatory Hiring Practices

Often, potential employers will see an LGBTQ applicant as a liability and will pass them up for employment. Individuals who are just as qualified as their peers to perform a certain job should not have their sexual orientation or gender identity work against them. If it can be proven that this was why an employee was not hired, then it can be considered LGBTQ discrimination. Additionally, transgender employees usually struggle to find employment because employers do not want to accommodate their needs.

Wrongful Terminations for LGBTQ Employees

In contrast to discriminatory hiring practices, individuals in the LGBTQ community may also suffer from discriminatory firing practices as well. Such incidences usually occur when an individual “comes out” or has their sexuality revealed to their coworkers. If a termination came in the wake of an employee coming out to their coworkers, it may have been a wrongful termination based on their sexual orientation or gender identity.

Anti-Discrimination Laws for LGBTQ Workers

Individuals who are concerned about the omission of LGBTQ individuals from the Civil Rights Act of 1964 can look to their own state’s laws. As of April of 2016, Pennsylvania Governor Tom Wolfe signed two executive decisions banning LGBTQ discrimination in Pennsylvania. Many states including the District of Columbia have such laws in place to protect the rights of LGBTQ individuals. Furthermore, for states without such laws, many legal teams will cite sexual discrimination as per the Civil Rights Act of 1964. Our Chester County LGBTQ employment discrimination lawyers will cite both state and federal laws in your case to fight for your rights.
