New Jersey Employment Law
For over 40 years, Sidney L. Gold & Associates, P.C. has guided employees through confusing and sometimes perilous issues regarding employment in New Jersey. Many employees take on a position and may be unaware of or misunderstand the laws governing employment that are meant to protect their rights. Our New Jersey employment lawyers will deconstruct the guidelines and provide representation that puts your best interests first when handling employment matters, such as harassment, discrimination, disputes over contracts or wages, wrongful termination, and other work issues that may arise. Our law firm covers the following issues within employment law:
- Employment discrimination involving age, disability, HIV status, marital status, nationality, race, religion, sex and gender, or sexual orientation
- Pregnancy discrimination, including childbirth and related medical conditions
- Sexual harassment by a colleague, employer, or through other work relationships
- Hostile work environment, including sexual harassment or workplace bullying
- Wrongful termination
- Retaliation and whistleblower claims
- Wage and overtime claims
- Employment contract negotiation, contract disputes, non-compete and non-solicit provisions, confidentiality agreements, and severance agreements
- New Jersey Paid Sick Leave law, newly enacted in October 2018 where employees can earn paid sick time off
- New Jersey Family Leave Act
- New Jersey Law Against Discrimination (NJLAD)
At-Will Employment and Wrongful Termination
Since New Jersey is an at-will employment state, an employer may dismiss an employee for various reasons, some that may even seem unfair to the terminated worker. This may be a blow to your pride and livelihood, but it does not constitute filing a wrongful termination claim against your boss or employer. Circumstances that do warrant filing a suit encompass any form of workplace discrimination or retaliation, failing to honor your right for taking advantage of the Family and Medical Leave Act and other comparable benefits, if you signed an employment contract, or those in civil service and tenured professions.
New Jersey Law Against Discrimination
New Jersey leads the nation in protecting the civil rights of workers who experience workplace discrimination. If you dealt with discrimination involving your age, disability, HIV status, marital status, nationality, race, religion, sex and gender, sexual orientation, or pregnancy discrimination, you may file a suit against your employer. The NJLAD mandates that employees will be protected against workplace discrimination. We will support your claim after determining the nature of the discrimination you encountered and will advise you on the most just course of action.
New Jersey Paid Sick Leave
The recently enacted New Jersey Paid Sick Leave law allows employees to accrue time off to tend to sick family members and loved ones or for their own personal health needs. Every employee throughout the state is eligible for this benefit, and employers must comply by offering it to their staff, no matter a worker’s specific employment status with the company. We will hold an employer accountable if they fail to honor the policy.
