At-Will Employment and Wrongful Termination
Since New Jersey is an at-will employment state, an employer may dismiss an employee for various reasons, some that may even seem unfair to the terminated worker. This may be a blow to your pride and livelihood, but it does not constitute filing a wrongful termination claim against your boss or employer. Circumstances that do warrant filing a suit encompass any form of workplace discrimination or retaliation, failing to honor your right for taking advantage of the Family and Medical Leave Act and other comparable benefits, if you signed an employment contract, or those in civil service and tenured professions.
New Jersey Law Against Discrimination
New Jersey leads the nation in protecting the civil rights of workers who experience workplace discrimination. The NJLAD mandates that employees will be protected against workplace discrimination. New Jersey Paid Sick Leave
The recently enacted New Jersey Paid Sick Leave law allows employees to accrue time off to tend to sick family members and loved ones or for their own personal health needs. Every employee throughout the state is eligible for this benefit, and employers must comply by offering it to their staff, no matter a worker’s specific employment status with the company. We will hold an employer accountable if they fail to honor the policy.
