Gold & Associates, has filed a wrongful termination lawsuit on behalf of his client who alleges racial discrimination and harassment as an employee of PL Phase One Operations LP, doing business as Xfinity Live! Philadelphia. The plaintiff, an African-American, worked as a security guard and operations manager from January 1, 2012 until May 23, 2014. During his employment, he asserts that he suffered relentless, racially-motivated verbal abuse and discrimination. According to the complaint, the employee reported the harassment and discriminatory conduct to a human resources coordinator on May 2, 2014, who failed to take action to address the problem.
Following his complaint to the human resources department, the plaintiff received a negative performance review and was terminated on May 23, 2014. The suit alleges the negative performance review was unjust and given in an act of retaliation because the employee had reported racial discrimination; therefore, Xfinity Live! Philadelphia violated Title VII of the Civil Rights Act and the Pennsylvania Human Relations Act. The lawsuit seeks compensation for lost wages and benefits, front pay, pre- and post- judgment interest, punitive damages, compensatory damages, attorney and expert witness fees, and the cost of lawsuit and a trial by jury.
