The Wiretap Act prevents employers from using spyware to follow an employee’s online activity without their permission. The Computer Fraud and Abuse Act (CFAA) prevents employees from accessing unauthorized corporate information, or from deleting emails or files without permission from their employer. In some cases, civil liability and damages can be awarded to employees when an employer violates the SCA or Wiretap Act, which can include recovery of lawyer and court costs.
