Recent legislation has been enacted and has become a valuable tool in protecting employee and employer privacy.  The Stored Communications Act (SCA) protects an employee’s email and social media sites, such as Facebook or Linkedin, from an employer’s unauthorized access.  The Wiretap Act prevents employers from using spyware to follow an employee’s online activity without their permission.  The Computer Fraud and Abuse Act (CFAA) prevents employees from accessing unauthorized corporate information, or from deleting emails or files without permission from their employer.  In some cases, civil liability and damages can be awarded to employees when an employer violates the SCA or Wiretap Act, which can include recovery of lawyer and court costs.
