Wiretap Act
Sidney L. Gold & Associates are staunch advocates for protecting the integrity of the Internet and the rights of employees in matters concerning privacy of electronic communication. Employees who have had their employer unlawfully record or obtain information from electronic communication devices are protected under the federal Wiretap Act. The Wiretap Act prevents unauthorized recording of personal information made through electronic communication, such as telephone calls and other electronic communications. Most employers have the right to record the business related telephone conversations and electronic communications of their employees, however they are prohibited from recording, listening to, or reading their personal conversations. Violations to the Wiretap Act can also be made when employers use Spyware to track the computer activity of their employees. Those who have had their rights under the Wiretap Act violated may be entitled to collect compensation for damages from their employer.
