At the time the lawsuit was initially filed in 2012, the 800 field employees of Mavis Discount Tire, Inc. were male with the exception of one female. According to the suit, 1,300 men were hired in field positions by Mavis between 2008 and 2010. The sole female field employee was hired in 1990. The suit also claimed that Mavis failed to keep applications and resumes submitted that would have substantiated the plaintiff’s claims that the company refused to interview and hire qualified female applicants. The EEOC mandates that corporations maintain applications for employment on file as evidence in the event of a dispute. Failure to do so made it impossible for the EEOC to include all applicants that would have qualified for inclusion in the class action suit.

In the settlement, Mavis Discount Tire Company agreed to pay $2.1 million in damages that will be evenly distributed among the 48 plaintiffs. They have also agreed to establish and implement hiring goals for women, create new overall recruitment and hiring procedures, and mandate anti-discrimination training to prevent future discriminatory practices.
