Gold of The Gold Law Firm P.C. is representing the plaintiff in a wrongful termination suit against former employer, Jowitt and Rodgers Company, which was filed at the Philadelphia County Court of Common Pleas on March 16, 2018. Allegedly, the plaintiff sustained a workplace shoulder injury on October 19, 2016, and subsequently filed a Workers’ Compensation claim. The plaintiff who was employed by the company for 20 years returned to work after the employer’s doctor examined the worker, diagnosed him with the shoulder injury, and approved him for performing lighter duties until a follow-up appointment about a week later. The injured worker stated that the employer, however, retaliated by offering his work assignments to other employees despite his ability to handle the tasks even after he received medical clearance at his follow-up appointment to return to his previous duties. On November 7, 2016, he was fired by the employer.

Under the Pennsylvania Workers’ Compensation Act, workers are protected from workplace retaliation in a situation like the aforementioned case. Allegedly, the plaintiff’s act of filing a Workers’ Compensation claim was the only event that preceded his wrongful termination.
