Philadelphia Whistleblower Lawyers Secure $550,00 Settlement for Qui Tam LawsuitThe Gold Law Firm P.C. secured a $550,000 settlement in a False Claims Act lawsuit against the intra-operative medical monitoring company, Marshfield Medical, Inc., formerly known as Bromedicon, Inc. Our whistleblower lawyers filed the Qui Tam case under seal in the US District Court for the Eastern District of PA. The US Dept of Justice undertook an investigation of the claims. On Monday, March 12, 2018, the US Attorney March announced that as a result of the investigation it was concluded that the claims had merit and the company agreed to settle for $550,000.

Allegedly, Bromedicon, which provided remote Intraoperative Neurophysiological Monitoring (IONM) during surgeries, submitted false claims for reimbursement to Medicaid and other federal health care programs. IONM is a type of medical monitoring for brain and spinal surgeries by qualified physicians who interpret the surgeries and results in real time and are in direct contact with a technician present in the operating room. The company apparently failed to provide qualified physicians to interpret the information including using a foreign medical school graduate who did not possess a United States medical license, and, in some cases, failed to enlist any medical personnel at all to monitor surgeries yet still submitted reimbursements. Under the False Claims act, the settlement is filed under qui tam or whistleblower provisions.
